Tourist agencies

Requirements
The services may be provided by legal or natural persons, i.e. companies, cooperatives, sole traders and craftsmen registered to provide tourist agency services.
 
A decision on meeting the requirements should be obtained from state administration offices in counties, i.e. the City of Zagreb office competent for tourism in accordance with the location of the registered office, i.e. a branch office or business premises of the agency.
 
In order to provide services, a tourist agency shall have an office, i.e. business premises meeting the requirements in terms of arrangement and equipment, as well as employees in accordance with the type of services provided.
           
By way of exception, a tourist agency providing online services directly to a client (online agency) may provide services in a housing space, i.e. a registered residence of the travel office manager.

In addition to the travel office manager, the online agency in the residential premises may employ only one more person.
 
A tourist agency providing services directly shall have at least one employee per an office, and if there is no office, it shall have at least one person employed on full-time basis meeting the requirements as a travel office manager.
 
Requirements for a travel office manager:

  • Croatian citizenship or citizenship of the EU or EEA countries
  • Legal competence
  • Having at least secondary school qualifications
  • A proficiency in one world language, knowledge of one more foreign language and knowledge of Croatian language to the level required for the travel office manager
  • A proof of passing certification exam for a travel office manager
  • Two years of work experience performing adequate tasks in a tourist agency or other adequate jobs in tourism
  • A person intending to provide the services may not be that to whom security measures under a court decision or decision on misdemeanour offence prohibiting provision of travel office manager services have been imposed while these measures are on-going

 
Foreign citizens who have a company or trade/craft for the provision of tourist agency services which is registered in the Republic of Croatia or who have received a permanent residence permit in the Republic of Croatia may perform the job of office manager subject to the consent of the Ministry, provided that they meet the conditions for office manager.
 
Documents
For issuing a decision on meeting the requirements for provision of tourist agency services should contain the following elements:

  1. An application – look E-procedure,
  2. A company and a registered office of the tourist agency,
  3. A decision on entering into a Register of Companies or a Trades and Crafts Register,
  4. A list of services to be provided,
  5. A proof of the right to use the office, i.e. business premises
  6. Information and evidence on arrangement and equipment of the office, i.e. business premises
  7. Information on the travel office manager and evidence on meeting the requirements for the travel office manager, i.e. on the person meeting the requirements for the travel office manager if the tourist agency provides the services directly to the client
  8. Proof of the requirements of “usability” of the building according to the Building Act (Official Gazette, No. 153/13, 20/17

a) Use permit
b) In accordance with Article 175 the Building Act, the official acts and documents, issued before entering into force of The Building Act, shall be considered as a use permit:
Buildings built up to 15 February 1968:
– Certificate of the office for cadastral and geodetic affairs that the house is entered in the cadastral register before 15 February 1968 (with the excerpt from cadastral plan as an integral part of the certificate)
Buildings built from 16 February 1968 to 19 June 1991:
– Final use permit or
– Legally valid building permit issued up to 19 June 1991 and certificate of the building inspection that there is no a building inspection proceeding related to that building
Buildings built from 20 June 1991 to 1 October 2007:
– Final use permit or
– certificate for the use which establishes that the building was constructed in accordance with building permit in terms of external dimensions and purpose
 Buildings built from 1 October 2007:
– Final use permit
– For the facilities up to 400 m2 – the report of the supervisory engineer concerning performance of the building with the proof that the investor has delivered the said report to the competent building authority
c) In accordance with Article 177 of the Building Act, following documents shall be considered as a use permit:
For reconstructed buildings
- Decision on the as-built condition and certificate of the as-built condition, according to Article 177 paragraph 3 of the Building Act
For legalized buildings
- Decision on the as-built condition according to Act on Proceeding with Illegally Built Buildings (Official Gazette, No.90/11)
- Decision on the as-built condition for the finished building according to Act on Proceeding with Illegally Built Buildings (Official Gazette, No.86/12)
d) Excerpt from land register if the recordation states that the use permit was submitted
 
Fee
Administrative fee

  • for the application forms submitted to The City of Zagreb according

to The Tariff No. 1 The Regulation of Tariffs of Administrative fees

  • for the decisions issued by the State Administrating Offices in the County, The City of Zagreb and Ministry of Tourism, administrative fee shall be charged according to The Tariff No. 33 The Regulation of Tariffs of Administrative fees (Official Gazette, No.  8/17)                                                                                                       HRK 350

 
Payment of the administrative fees:
– directly to the prescribed account irrespective of the amount

  •  amount up to HRK 100 can be paid also in state stamps

 
Information for e-payment of administrative fee:
- fill according to information stated by the competent authority to which request for issuing a decision was submitted – information for payment of the administrative fee
 

E-PROCEDURE for obtaining the decision on fulfilment of requirements for provision of services of a tourist agency
  • Request (application form) must be filled and signed
  • Request must be sent to the e-mail address of the competent authority, with all necessary documents and the proof of e-payment of the administrative fee –all scanned in pdf
  • If the documents are sent via e-mail, there is no obligation of sending via post or bringing the documents physically
  • Decision on performing services can be sent, at the request sent to the competent authority, via e-mail. The same decision will be sent via post afterwards. Term for rendering a decision is at the latest within 60 days, counting from the day of duly performed submission of the request (in cases when investigatory procedure is carried out – inspection)
  • catering and hospitality service can be performed after receiving the decision (executive decision)

Decisions of the competent office may be appealed to the Ministry of Tourism. Against the decision of the Ministry of Tourism administrative proceedings may be initiated
